Terms of Service

NovixLink Terms of Service

1. Introduction and Acceptance of Agreement
1.1 These Terms of Service (the “Agreement”) constitute a legally binding agreement between you (the “User” or “you”) and the owner and operator of the NovixLink.com website and related services (collectively, the “Service”), referred to as “NovixLink,” “we,” “us,” or the “Company.” By registering an account, purchasing, or using any Service, you confirm that you have read, understood, and agreed to be bound by this Agreement and our policies as updated from time to time, including but not limited to the Acceptable Use Policy / Fair Use Policy. If you do not agree to this Agreement or any related policy, you must stop using the Service immediately.

2. Service Provision and Scope
2.1 We will provide the relevant Service according to the service description displayed on our website, client portal, or order page.
2.2 Our technical support scope is limited to platform-side infrastructure and availability, such as node network, host hardware, and control panel functions. You are expected to have the ability to independently manage a Linux/Windows VPS. Software, applications, code, and data inside the VPS are your sole responsibility.
2.3 Unless otherwise expressly stated on the product page, order page, or in written instructions, all descriptions, delivery acceptance, after-sales explanations, and dispute handling related to IP attributes, ASN information, AS Type, company information, ISP/business/hosting classification, and “Dual-ISP Residential IP” shall be determined solely by the IPinfo.io query result at the time of service activation/delivery. Due to differences in database sources, update frequency, identification logic, and display methods, other third-party lookup platforms may show results that differ from IPinfo.io. Such results are for reference only and shall not be used as a basis for product mismatch, refund, compensation, or dispute handling. In case of dispute, the IPinfo.io query result at the time of activation/delivery, or delivery screenshots and ticket records retained or provided by us, shall prevail.
2.4 For ISP Broadband IP, Cox Dual-ISP Residential Broadband IP, or any other special product expressly marked on the product page, order page, knowledgebase, announcement, or written instructions as subject to the ISP Broadband IP Special Strict Refund Policy, you understand and agree that the IP type is mainly determined by IP source, ASN attributes, operator ownership, and the query result at the time of delivery. The physical server location alone does not determine the IP type. Such products only guarantee that the IP source is consistent with the product description. We do not guarantee any third-party platform, risk control system, database, detection website, or business system’s IP identification result, risk score, geolocation, Google region, account success rate, unlocking result, or long-term business result.

3. User Account and Security
3.1 You agree to provide true, accurate, and complete registration information, and you are responsible for all activities under your account.
3.2 If any unauthorized use or security incident occurs, you must notify us as soon as you become aware of it and cooperate with necessary risk control and remediation measures.

4. Data Backup and Data Disclaimer
4.1 The platform may use RAID and basic disaster recovery measures to improve overall availability, but this does not constitute a data backup service or data recovery commitment for individual users.
4.2 You are fully responsible for the security and integrity of your own data. We are not liable for data loss, damage, or unrecoverability caused by any reason. We strongly recommend that you regularly maintain your own backups and verify their availability.

5. Special Notice Regarding Mainland China Network Accessibility
5.1 Due to cross-border network conditions, carrier routing policies, link congestion, and regional network policy adjustments, the actual access experience of the Service may vary by region, carrier, and time. We do not guarantee that all IPs will maintain consistent accessibility and stability in all network environments in mainland China.
5.2 If the Service is inaccessible after delivery while unused, and we determine that the issue is not caused by user-side configuration, we may provide one free IP replacement per service.
5.3 Availability fluctuations or temporary inaccessibility caused by the above uncontrollable network factors shall not be considered service quality issues and shall not constitute a refund reason.
5.4 We recommend that you perform Ping/MTR/routing tests before purchase. If you require higher cross-border connection stability, you should plan an appropriate access method or route optimization solution by yourself, such as deploying access points in nearby regions or using content delivery network services.
5.5 For products clearly marked as non-China-optimized routes or ISP broadband routes, including but not limited to ISP Broadband IP, Cox Dual-ISP Residential Broadband IP, and other special products, we do not guarantee direct access quality from mainland China, cross-border latency, packet loss, route detour, Google region display, or any international interconnection performance. If you need cross-border access, you should prepare your own cross-border acceleration or other network optimization solution.

6. Payment, Renewal, and Expiration Handling
6.1 You must pay the selected Service fees on time, and you may enable or disable automatic renewal in the client portal where applicable.
6.2 Services without automatic renewal enabled or with failed renewal payment will be handled as follows:
(1) An invoice will be generated automatically 7 days before expiration;
(2) An email reminder will be sent 24 hours before expiration;
(3) The Service will be automatically suspended at 00:00 on the expiration date, Toronto, Canada time;
(4) A 24-hour grace period will be provided after suspension. If renewal is not completed by the end of the grace period, the server and data will be permanently deleted and cannot be recovered. The related IP resources will be released and may be reassigned.

7. Refund Policy
7.1 For newly purchased VPS services only, a full refund may be requested within 24 hours from the time of purchase, provided that the IP is not blocked in a specific country, no abuse has occurred, and the service has not violated this Agreement or the AUP/FUP. Except for payment methods otherwise specified in this Agreement, eligible refunds are usually returned to the original payment method. If you have specific requirements before purchase, such as confirming whether a certain country can access the service, whether a certain platform is usable, or whether a certain network environment is suitable, we recommend contacting us before placing the order to confirm whether it can be completed, so as to avoid wasting your time.
7.2 For refund requests based on subjective reasons, including but not limited to “I no longer want it,” “local speed test did not meet expectations,” or “some websites identify the IP as datacenter IP,” if we agree to process the refund, a 3% payment gateway fee will be deducted before refunding. For the above situations, disputes regarding IP attributes, ASN, network type, and “Dual-ISP Residential IP” shall be determined according to Sections 2.3 and 2.4 of this Agreement.
7.3 For orders paid by cryptocurrency or any on-chain digital asset, because blockchain transactions are usually irreversible once confirmed, and due to network fees, exchange rate fluctuations, payment gateway processing limitations, and compliance risks, even if the order is eligible for a refund, it cannot be refunded to the original cryptocurrency address. Such refunds can only be issued as website account credit. The credit amount shall be based on the actual amount received and converted by us for the order. We do not compensate for cryptocurrency price fluctuations, on-chain fees, withdrawal fees, or exchange rate differences.
7.4 ISP Broadband IP Special Strict Refund Policy: ISP Broadband IP, Cox Dual-ISP Residential Broadband IP, or any other special product expressly marked on the product page, order page, knowledgebase, announcement, or written instructions as subject to this policy is subject to the special strict refund policy. Such products are scarce resources, and their IP source, bandwidth cost, provisioning cost, and maintenance cost are significantly higher than ordinary VPS products. Once provisioned, the relevant IP, bandwidth, and service resources are immediately occupied. Unless there is an extremely special reason, no refund will be provided.
7.5 The “extremely special reason” stated in Section 7.4 generally only includes cases where the Service was not provisioned properly, the delivered content is clearly inconsistent with the order description, or a delivery issue is confirmed by our technical review to be caused by NovixLink and cannot be resolved. Whether a case qualifies for a refund is subject to NovixLink’s final review.
7.6 For the special products stated in Section 7.4, the following are not refund reasons: refund without reason; dissatisfaction with third-party detection results; IP risk score, fraud score, cleanliness score, database label, or platform identification difference; whether Google routes or identifies the IP as China-related, Google Search region, YouTube region, Google Ads, or any Google-related detection result; TikTok, Amazon, Meta, PayPal, Stripe, Netflix, ChatGPT, or any other third-party platform not identifying the IP as ISP broadband; account registration, store operation, advertising, streaming unlocking, AI platform usage, or any third-party business result not meeting expectations; poor results caused by the user’s local network, proxy software, cross-border route, browser fingerprint, account information, usage habits, or business operation methods; subjective reasons after purchase such as “not suitable,” “the detection result does not look good,” “I no longer want it,” or “the result is not as expected.”
7.7 The following cases are not eligible for refund:
(1) Orders older than 24 hours;
(2) Suspension or termination caused by violation of this Agreement or the AUP/FUP;
(3) Risk events caused by abuse or high-risk behavior, including but not limited to IP reputation damage, being flagged by third-party security systems, or blacklisting;
(4) Dedicated servers, software licenses, and value-added services;
(5) Orders for which a payment dispute/complaint has been initiated through the payment channel, until the dispute is resolved or according to the final ruling;
(6) Orders that are clearly subject to the ISP Broadband IP Special Strict Refund Policy and do not meet the special reasons stated in Section 7.5.
7.8 Each user may receive refund eligibility at most once, including but not limited to the same household, same network environment, same payment information, or other situations that can reasonably be determined as the same actual user.
7.9 If we proactively terminate the Service under Section 9.3 of this Agreement, the refund rules shall follow Section 9.3.

8. Disclaimer and Limitation of Liability
8.1 The Service is provided on an “as is” and “as available” basis. We make no express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or continuous uninterrupted availability.
8.2 To the maximum extent permitted by law, we shall not be liable for any direct or indirect loss caused by the use or inability to use the Service, including but not limited to data loss, profit loss, business interruption, or loss of goodwill.
8.3 In any case, our cumulative liability to you shall not exceed the total service fees you paid to us during the three months before the claim arose.
8.4 We do not guarantee that any third-party platform, website, risk control system, social media platform, e-commerce platform, payment institution, or security service provider’s identification result, risk score, label classification, account registration success rate, business approval rate, or long-term availability for the relevant IP will be consistent with the IPinfo.io query result. IPinfo.io is only used as the unified reference standard for relevant IP attributes and delivery determination under this Service, and does not constitute any guarantee of third-party platform identification results or business results.
8.5 For ISP Broadband IP, Cox Dual-ISP Residential Broadband IP, or any other special product expressly marked on the product page, order page, knowledgebase, announcement, or written instructions as subject to the ISP Broadband IP Special Strict Refund Policy, we only guarantee that its IP source and delivery attributes are consistent with the product description and delivery records. We do not guarantee any platform’s internal risk control result, Google region display, account registration success rate, streaming unlocking, advertising performance, store operation result, AI platform availability, or any other third-party business result.

9. Suspension and Termination
9.1 If you violate this Agreement or the AUP/FUP, we have the right to take immediate restriction measures, including but not limited to rate limiting, suspension, or termination of the Service, and no refund may be provided.
9.2 For suspension caused by overdue payment, we may restore the Service after you pay the outstanding amount, provided that the relevant data has not been deleted under Section 6.2.
9.3 To the maximum extent permitted by law, we have the right, at our sole discretion, to restrict, suspend, or terminate all or part of the Service at any time under any circumstances. If such termination is not caused by your violation of this Agreement, AUP/FUP, non-payment, fraud, abuse, high-risk behavior, or other reasons attributable to you, we may refund the prepaid fees corresponding to the remaining unused service period on a pro-rata basis to the original payment method or issue it as account credit. Orders paid by cryptocurrency or on-chain digital assets can only be issued as account credit. Except for the above pro-rata refund, we shall not bear any further liability or compensation obligation.

10. Modification of Agreement
10.1 We may update this Agreement at any time and publish it on the website with the “Last Updated” date. If you continue to use the Service after the update takes effect, you are deemed to have accepted the revised terms. We encourage you to visit this page regularly to obtain the latest Agreement information.
NovixLink Acceptable Use Policy / Fair Use Policy
This policy is an integral part of the Terms of Service and applies to your use of all services provided by NovixLink, including but not limited to VPS, shared hosting, dedicated servers, network/IP related products, and add-on services. By using or continuing to use the Service, you are deemed to have read and agreed to this policy.

1. Legal Compliance and Account Responsibility
1.1 You may only use the Service for lawful purposes and must comply with applicable laws, regulations, and regulatory requirements of Canada, the United States, and your location, such as the People’s Republic of China where applicable.
1.2 You are responsible for all actions and consequences under your account, including actions generated by yourself, employees/partners, end users, or any authorized or unauthorized visitors.
1.3 You must take reasonable security measures, such as updating patches, using strong passwords/keys, and disabling unnecessary services. If an instance is compromised and generates spam, attack traffic, malicious scanning, or other violations, we may immediately take restrictive measures until the risk is removed and remediation is completed.

2. Fair Use and Shared Resource Rules
2.1 Except for dedicated IPs, VPS itself operates in a shared resource environment and usually provides short-term burst capacity. Sustained high load or abnormal usage may trigger fair use restrictions. Unless otherwise agreed in writing, this section does not constitute a strict guarantee or SLA for sustained compute power, sustained bandwidth, or sustained I/O.
2.2 CPU: Short-term burst usage is allowed. Long-term high usage or continuous occupation for stress testing/benchmarking purposes is prohibited. When necessary, we may reduce priority, limit frequency, restrict scheduling, or suspend the Service. Such restrictions are usually removed automatically after the load returns to normal or after manual review.
2.3 Bandwidth and Network: Short-term burst usage up to the port limit is allowed. Users should not run traffic at full speed for a long time, occupy a large proportion of port speed for a long time, or transmit traffic at the expense of others’ experience. We may apply rate limits, priority reduction, port blocking, or suspension based on sustained usage, abnormal connection counts/packet rate (PPS), congestion, and packet loss impact.
2.4 Disk I/O: Sustained high I/O, abnormal random IOPS, storage stress testing, or behavior that causes long-term congestion in the host storage queue may trigger rate limits or suspension.
2.5 Network Stability Tools and Behavior: It is prohibited to use or deploy tools or behaviors that may damage network stability, including but not limited to multiple packet sending, duplicate packet sending, forged ACK, abnormal congestion control/acceleration, FinalSpeed or similar mechanisms, unofficial BBR, and any network “acceleration/optimization” method that affects others or platform stability.

3. Traffic Exhaustion and Reset (Applicable to Metered/Monthly Traffic Products)
3.1 When you have used up the monthly traffic allocated for the current billing cycle, the system will automatically disconnect or suspend network access for the Service until the billing cycle resets.
3.2 If early restoration is required, you may submit a ticket to request a paid traffic reset. The reset fee will not exceed the monthly average price of the Service in the current billing cycle, such as the monthly average after quarterly or annual payment conversion.
3.3 Traffic statistics are based on our metering system. Unless expressly stated in the product description, traffic does not carry over or accumulate.

4. Email SMTP and High-Risk Ports
4.1 To control spam and IP blacklist risks, outbound mail delivery related ports are restricted by default, including but not limited to ports 25/2525 and equivalent ports.
4.2 If you have compliant email needs, you may submit a ticket for evaluation. We may decide whether to open, limit, or revoke permission at any time based on complaint rate, bounce rate, blacklist risk, and completeness of business compliance materials.
4.3 Any UCE/UBE, mail bombing, or behavior that assists spam is prohibited. When using the Service to send commercial electronic messages, you must ensure that you have obtained lawful consent, provided truthful identification information, and provided a valid unsubscribe mechanism, and you must not violate applicable anti-spam laws of Canada, the United States, or the target market.
4.4 For ISP Broadband IP, Cox Dual-ISP Residential Broadband IP, or any other special product expressly marked on the product page, order page, knowledgebase, announcement, or written instructions as subject to the ISP Broadband IP Special Strict Refund Policy, SMTP, mail delivery, bulk marketing email, mail relay, mail proxy, mass mailing, or any use that may cause the IP to be blacklisted is considered high-risk use. Such use is prohibited unless we provide written permission.

5. It is strictly prohibited to use, facilitate, or allow the Service for the following activities, including but not limited to:
5.1 Illegal/Harmful Content and Activities: Pornography, gambling, fraud, money laundering, defamation, privacy violations, incitement of violence/hatred, terrorism-related content; child sexual abuse material (CSAM) and related distribution/storage/traffic redirection; and any content that violates the laws, regulations, or public order and morals of the server location or your location.
5.2 Infringement and Piracy: Distribution/hosting of unauthorized copyrighted, trademarked, or patented materials. We may process complaints and takedown/disconnection requests according to the DMCA or equivalent procedures.
5.3 Network Attacks and Malicious Behavior: DDoS, whether initiated or assisted; port scanning; vulnerability probing; weak password brute-force attacks; sniffing; IP spoofing; phishing; malicious redirects; viruses, Trojans, ransomware, botnets, C2; acting as a reflection/amplification source, such as open DNS/NTP/SSDP/CLDAP/Memcached.
5.4 Resource Abuse and High-Risk Business: Cryptocurrency mining, “traffic mining,” cluster computing/rendering, long-term stress testing; BT/PT, traffic exchange/click exchange, video idling, abnormal crawlers/large-scale scraping, long-term full-speed traffic; public proxies, open proxies, open Socks5/HTTP/HTTPS proxies, Tor relay/exit, or providing anonymized exit services to the public; nested virtualization/re-virtualization or using emulators/virtualization to evade resource and risk control restrictions.
5.5 Tools/Uses That Evade Regulation or Damage Network Security: It is prohibited to run, provide, or distribute forwarding/tunneling/proxy/jump host/exit service models used to evade network management, damage carrier network security, or clearly increase abuse and complaint risks.
5.6 Resale and Sharing: Unless you have joined our written authorized reseller/agent program, it is prohibited to resell, publicly share, rent accounts/instances, or provide reusable access permissions to unspecified third parties. For ISP Broadband IP, Cox Dual-ISP Residential Broadband IP, or any other special product expressly marked on the product page, order page, knowledgebase, announcement, or written instructions as subject to the ISP Broadband IP Special Strict Refund Policy, without written permission, it is prohibited to package the Service as a public proxy pool, shared proxy, proxy landing node, bulk exit, third-party account operation infrastructure, or any anonymized exit resource for unspecified third parties.
5.7 Support System Abuse: Abusing, threatening, or harassing support staff is prohibited. Meaningless tickets, ticket bombing, or other disruptive behavior is prohibited. When necessary, we may restrict access to support channels.

6. Security Testing and Scanning Rules
6.1 Permitted Scope: Security testing may only be performed on assets that you own and have the right to control, and it must not affect others or occupy shared resources for a long time;
6.2 Prohibited Behavior: Scanning or penetration testing third-party assets or targets that do not belong to you; large-scale internet scanning; destructive testing; exploiting vulnerabilities to cause unauthorized access, data damage, or service interruption. Unreported testing or testing that causes impact may be treated as a violation.

7. Enforcement Measures, Compliance Cooperation, and Appeals
7.1 We may take one or more measures based on risk and severity: require remediation within a specified period, rate limit/priority reduction, port blocking, temporary suspension, termination of Service, deletion or disconnection of access to violating content, and account freezing. Repeated, serious, or high-risk incidents may result in direct termination without refund.
7.2 For costs caused by your violation or compromised instance, including complaint handling, blacklist handling, emergency protection, and manual review, we may charge reasonable administrative fees at our discretion.
7.3 You must cooperate with our investigation and remediation of abuse complaints or lawful requests from regulatory/law enforcement authorities, including providing necessary explanations, authorization proof, and remediation timelines.
7.4 If you believe a restriction measure was applied by mistake, you may submit appeal materials through a ticket, and we will review the case.
7.5 For ISP Broadband IP, Cox Dual-ISP Residential Broadband IP, or any other special product expressly marked on the product page, order page, knowledgebase, announcement, or written instructions as subject to the ISP Broadband IP Special Strict Refund Policy, because upstream resources are scarce and IP reputation maintenance costs are high, we will apply stricter abuse review. Once public proxy use, spam, fraud, phishing, copyright complaints, malicious scanning, blacklisting, platform complaints, or any other event that may damage IP reputation occurs, we may immediately suspend, terminate, or remove the Service, and no refund will be provided.

8. Disclaimer, Governing Law, and Amendments
8.1 To the extent permitted by law, any direct or indirect loss arising from your use of the Service, including business interruption, data loss, and loss of goodwill, shall be borne by you. Unless otherwise agreed in writing, we do not guarantee third-party software configuration or business compliance conclusions.
8.2 The formation, effectiveness, performance, and interpretation of this policy shall be governed by the laws of Canada. Where provincial law applies, the laws of the province where our main operation is located shall apply. Disputes should first be resolved through negotiation. If negotiation fails, disputes shall be submitted to a court with jurisdiction in the place of our main operation, unless applicable law mandatorily requires another jurisdiction.
8.3 We may update this policy based on compliance, risk control, and business adjustment needs, and notify users through website announcements, client portal notices, emails, or other methods. Continued use of the Service after the update shall be deemed acceptance of the updated content.
NovixLink Affiliate Policy
1. Commissions and Calculation
1.1 We offer a recurring 15% commission on orders placed by new users who sign up through your referral link.
1.2 Commissions will be automatically settled into your affiliate account 7 calendar days after a qualifying order is placed and become available for withdrawal once the minimum withdrawal threshold is met.
1.3 Commissions are void for any orders that are refunded, chargebacked, frozen due to disputes, or deemed fraudulent.
1.4 Commission tracking relies on cookies. If an invited user clears their browser cookies before placing an order, commissions may not be accurately calculated.

2. Withdrawals and Payment Methods
2.1 Minimum withdrawal amount: CAD 10.
2.2 We prioritize PayPal for payments.
2.3 We reserve the right to request Wire Transfer details for payment when necessary.
2.4 Withdrawal requests cannot specify payment methods; payments will be processed via either PayPal or Wire Transfer.
2.5 All withdrawal requests must be submitted via a support ticket to our Sales Department. Monitor ticket updates closely and promptly provide any requested information to avoid delays.

3. Fraud and Forbidden Practices
The following are strictly prohibited and will result in account termination and forfeiture of unpaid commissions:
Fake registrations/clicks, non-natural traffic, cookie stuffing, or any artificial boosting;
Self-referrals, multi-accounting from the same IP/device/payment profile;
Posting affiliate links via unsolicited emails/DMs or harassment-style promotion; 
Impersonating NovixLink or using confusing branding to imply official affiliation; 
Offering cash-back or improper monetary incentives to force clicks/orders. 

4. Review and Adjustments
We may review your traffic sources at any time. If the source cannot be reasonably verified, we may deny withdrawals or void commissions. We may adjust commission rates prospectively due to business needs.
